Srinagar, February 5, 2026 : The High Court of Jammu and Kashmir and Ladakh will hear further arguments next week in the case challenging the detention of Aam Aadmi Party (AAP) MLA Mehraj Malik under the Public Safety Act (PSA).
According to AAP spokesperson Mudasir Hassan, Justice Mohammad Yousuf on Thursday partially heard the arguments presented by the Jammu and Kashmir administration in support of Malik’s detention. The court has now listed the matter for further hearing on February 12, when the Union Territory administration will continue to justify the invocation of the PSA.
Mehraj Malik, the sitting MLA from the Doda constituency, was detained under the PSA in September last year. Following his detention, the Aam Aadmi Party moved the High Court, challenging the government’s action and seeking quashing of the detention order.
The case has drawn political attention, with the AAP maintaining that the PSA has been misused against an elected representative and asserting that Malik’s detention is unjustified. The party has repeatedly called for due process, transparency, and adherence to constitutional safeguards.
The High Court’s decision to hear detailed arguments from the administration is seen as a crucial step in determining the legality and validity of the detention. The matter is expected to be closely watched, given the political and legal implications surrounding the use of the PSA against an elected MLA.
Further proceedings in the case will take place on February 12.
