Srinagar, October 19: In OWP No. 782/2016 titled Abdul Rahim Bhat & Ors. V/s State of J&K and Ors. after hearing Hon’ble the Chief Justice. Hon’ble Mr Justice Sanjay Dhar, Judge. ORDERED as:-
The claim of the petitioners can be settled by the respondents without waiting for the decision of this Court with reference to the prayers made in the writ petition by giving them same treatment, which has been given to other similarly situated land owners, whose land has also been occupied for upgradation of the road.
To ensure such treatment, it has become necessary to ask the petitioners to approach the Respondents 2 and 4 within one week, who shall explore the possibility of settlement on the line of treatment qua compensation paid to the other land owners, with some additional benefit of interest.
The petitioners and the Respondent No. 4-Chief Engineer, Kashmir, PMGSY, Rajbagh, Srinagar, shall remain present with the Respondent No. 2- Collector Land Acquisition/Assistant Commissioner Revenue, Pulwama, on 29.10.2022, to ensure settlement of the claim.
Result of the settlement shall be filed by the Respondents 2 and 4 before the next date of hearing.
List again on 04.11.2022.
Copy of this order be provided to the Respondent No. 2- Collector Land Acquisition/Assistant Commissioner Revenue, Pulwama in person, as also to the counsel for the petitioners under the seal and signature of Bench Secretary of this Court today itself, copy whereof shall also be furnished to Mr. M.A. Chashoo, learned AAG for making available the same to the Respondent No. 4- Chief Engineer, Kashmir, PMGSY, Rajbagh, Srinagar, for compliance.
