NEW DELHI | October 29, 2026 : The Supreme Court has questioned how India would ensure adequate fuel supply if vehicles capable of running on 100% ethanol (E100) are permitted, raising important questions about fuel availability, manufacturing capacity, environmental concerns and the future of Indian farmers.

A bench of Justices M. M. Sundresh and Prasanna B. Varale raised the issue while hearing pleas concerning ethanol allocation for the Ethanol Supply Year (ESY) 2025–26.

🚗 WHAT HAS THE GOVERNMENT CHANGED?

On October 26, the Ministry of Road Transport and Highways notified amendments to the Central Motor Vehicles Rules, 1989, allowing flex-fuel vehicles capable of running on blends up to E100.

🔹 E20: 20% ethanol blended with petrol — the current national blending level cited in the report.

🔹 E85: 85% ethanol and 15% petrol.

🔹 E100: Nearly pure ethanol.

The amendments expressly include E100 alongside E85 in emission-certification provisions. However, permitting compatible vehicles does not itself establish that E100 fuel will be widely available.

⛽ THE BIG QUESTION: WHERE WILL THE FUEL COME FROM?

During Thursday’s hearing, the Supreme Court referred to media reports about permission for 100% ethanol-powered vehicles and asked how the required supply would be arranged.

Attorney General R. Venkataramani told the court that such a move would require large-scale manufacturing rearrangements.

The question comes as Petroleum and Natural Gas Minister Hardeep Singh Puri said on October 27 that the Centre had no immediate plan to increase ethanol blending in petrol beyond the existing 20% level.

🌾 SUPREME COURT PUTS FARMERS IN FOCUS

The bench stressed that ethanol policy must be considered in the context of wider public interest, environmental concerns and the welfare of farmers.

Justice Sundresh highlighted the need to empower farmers, particularly people living in rural India, describing their interests as an important aspect of the debate.

Counsel appearing in the matter argued that ethanol promotion could benefit farmers, while another lawyer said the Centre’s existing policy already takes farmers’ interests into account.

📌 THE POLICY CHALLENGE

The debate involves several interconnected issues:

✅ Fuel security: Ensuring adequate ethanol production and distribution before wider adoption of E100 vehicles.

✅ Manufacturing capacity: Preparing the supply chain for any significant increase in demand.

✅ Farmers’ livelihoods: Assessing how ethanol production and allocation policies can support agricultural communities.

✅ Environmental considerations: Evaluating the wider environmental implications of ethanol-based transport.

✅ Policy stability: Balancing the interests of ethanol producers, oil marketing companies, vehicle users and the broader economy.

🏛️ BACKGROUND: THE ETHANOL ALLOCATION DISPUTE

The Supreme Court is also considering a dispute over ethanol allocation for ESY 2025–26.

On June 30, the court ordered the parties to maintain the existing position regarding a Karnataka High Court direction on allocation.

The High Court had directed Bharat Petroleum Corporation Limited, Hindustan Petroleum Corporation Limited and Indian Oil Corporation Limited to consider a representation from an ethanol manufacturer seeking enhanced allocation.

The manufacturer argued that dedicated ethanol plants, established under government policy and contractually committed to supplying oil marketing companies, should receive the benefit of preferential allocation under long-term offtake agreements.

An oil marketing company challenged the High Court’s direction, arguing that it could destabilise the national E20 blending policy.

The Supreme Court has now listed the matter for hearing next month.

🔎 THE BIG PICTURE

India’s ethanol programme sits at the intersection of transport policy, energy security, agricultural income and environmental objectives.

But approving vehicles capable of using E100 and ensuring a reliable nationwide supply of the fuel are two different challenges.

The key question is not only whether vehicles can run on 100% ethanol, but whether production, distribution and policy arrangements can support that transition while protecting consumers and serving farmers’ interests.
