JAMMU, October 7, 2026 : A Special NIA Court in Jammu has declared a wanted terror accused, who is believed to be hiding in Pakistan, a proclaimed offender following an application filed by the National Investigation Agency (NIA).
The accused, identified as Nazir Hussain, is a resident of Hari village in Poonch district and is wanted in connection with a terror conspiracy case being investigated by the NIA.
Case Linked to Grenade Recovery
The case stems from the recovery of several grenades from an alleged overground worker in the Surankote area of Poonch in October 2024.
According to the NIA investigation, the consignment was allegedly sent from across the border by Hussain, who is also known by several aliases, including Ali Khan, Nasir, Naziru and Shaheen.
Investigators allege that the explosives were intended to be used in carrying out blasts.
The allegations form part of the ongoing investigation and will be subject to the judicial process.
Court Proceedings
The Special Judge (NIA), Jammu, Prem Sagar, considered the NIA’s application and, after hearing the matter on October 1, 2026, declared Hussain a proclaimed offender under Section 84 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
The court’s order followed earlier attempts by authorities to locate and arrest the accused.
Non-Bailable Warrants Issued Earlier
According to the court order, non-bailable warrants had previously been issued against Hussain.
However, the warrants could not be executed because the accused was not found at his residence.
The NIA’s execution report stated that Hussain had absconded to Pakistan.
The court subsequently considered the steps taken by the investigating agency to secure his appearance.
Notices Published to Secure Appearance
The court noted that the prosecution had made efforts to locate the accused and secure his appearance.
These efforts included the publication of notices in newspapers and the official Gazette of Jammu and Kashmir.
Despite these measures, Hussain neither appeared before the court nor surrendered to the authorities.
The court therefore concluded that he had deliberately avoided the legal process and proceeded to declare him a proclaimed offender.
Investigation Continues
The case remains part of the NIA’s investigation into an alleged terror conspiracy involving the movement of grenades into the Poonch-Surankote area.
The agency’s investigation is focused on establishing the alleged network behind the consignment and identifying individuals involved in its movement and intended use.
The declaration of Hussain as a proclaimed offender represents another legal step in the proceedings against the wanted accused.
Significance of the Court Order
A proclaimed-offender declaration enables authorities to formally proceed against an accused who has allegedly evaded arrest and failed to appear despite court directions and public notices.
In this case, the court’s order records that the accused could not be apprehended despite the issuance of non-bailable warrants and efforts to secure his appearance.
The legal proceedings against Hussain will continue in accordance with the applicable law.
