Srinagar, August 11, 2026 : The Jammu and Kashmir administration has notified a consolidated framework for ex-gratia relief to civilians, security personnel, government employees and others affected by law-and-order disturbances and militancy-related incidents.

The revised guidelines, issued by the General Administration Department (GAD) under the Security Related Expenditure (SRE) scheme, supersede the earlier order dated December 3, 2025.

₹25 Lakh for J&K Domicile Defence & CAPF Personnel

Under the new framework, the next of kin of a J&K domicile defence or Central Armed Police Forces (CAPF) personnel who dies in circumstances covered by the order will receive ₹25 lakh, irrespective of whether the death occurs within or outside the Union Territory.

For a non-domicile defence or CAPF personnel killed in J&K, the prescribed ex-gratia is ₹5 lakh.

Permanent disability of defence and CAPF personnel will attract ₹75,000, while partial disability will qualify for ₹10,000.

Relief for Civilians

The next of kin of a civilian killed in eligible circumstances will receive ₹1 lakh.

The same amount will apply to eligible deaths resulting from incidents on the International Border (IB) or Line of Control (LoC), as well as cases involving surrendered militants and militants who had turned informers.

For civilians, the revised injury compensation is:

  • Permanent disability: ₹75,000
  • Hospitalisation exceeding 24 hours: ₹5,000
  • Hospitalisation below 24 hours: ₹1,000
  • Minor injuries: ₹500

The order makes clear that relief to persons other than government employees will be available only when the victim was not directly or indirectly involved in violence or its instigation and was affected innocently.

Police Personnel to Get ₹5 Lakh for Death

For police personnel, including Special Police Officers (SPOs), the ex-gratia amount for death has been fixed at ₹5 lakh.

For ex-servicemen, the compensation will be:

  • Death: ₹2 lakh
  • Permanent disability: ₹75,000
  • Partial disability: ₹10,000

Police personnel killed or disabled in militancy-related incidents while on duly sanctioned leave will also remain eligible under the applicable provisions.

Government Employees Covered

Separate provisions have been prescribed for government employees other than police personnel.

The next of kin of a magistrate killed in eligible circumstances will receive ₹2 lakh, while the death of other government employees will attract ₹1 lakh.

The compensation for injuries and disability will follow the prescribed slabs, including ₹75,000 for permanent disability, ₹5,000 for hospitalisation exceeding 24 hours, ₹1,000 for shorter hospitalisation and ₹500 for minor injuries.

Relief Where Body Is Missing or Unidentified

The framework also addresses cases where there is no direct or conclusive evidence of death but a person has gone missing or the body remains unidentified.

In such cases, relief may be sanctioned following a personal inquiry by the District Magistrate, if the circumstances reasonably indicate that the person is presumed to have died.

The recipient will have to furnish an indemnity bond and surety bond, undertaking to refund the amount if later evidence establishes that the person had not died.

Up to ₹10 Lakh for Property Damage

The administration has also laid down compensation provisions for property damaged during counter-terrorism operations carried out by the Army or CAPFs.

Relief will be capped at ₹10 lakh or the actual assessed loss, whichever is lower, subject to verification by the District Level Screening Committee.

The ceiling includes:

  • Immovable property: Up to ₹7 lakh
  • Movable property: Up to ₹3 lakh

For damage caused by shelling or firing across the IB or LoC, relief will be 50% of the assessed loss or ₹1 lakh, whichever is lower.

Similarly, damage to immovable property caused by a bomb blast or other act of sabotage will qualify for relief of 50% of the assessed loss or ₹1 lakh, whichever is lower.

Who Will Sanction the Relief?

The revised framework assigns sanctioning powers to different authorities:

  • Deputy Commissioner: Eligible civilians and government employees other than police personnel
  • Director General of Police: Police personnel
  • Government Home Department: Defence personnel and CAPFs

Those dissatisfied with a Deputy Commissioner’s assessment of damage to immovable property can appeal before the concerned Divisional Commissioner within 30 days of the order.

The consolidated framework aims to provide a clearer, uniform and structured mechanism for financial assistance to victims and families affected by violence, border incidents, militancy-related incidents and counter-terrorism operations across Jammu and Kashmir.
