New Delhi, September 9, 2026 : The Delhi High Court on Wednesday asked the National Investigation Agency (NIA) whether , could be released on bail subject to stringent conditions in the ongoing terror-funding case.
A bench comprising Justices Prathiba M Singh and Vikas Mahajan directed the NIA’s counsel to obtain instructions on the possibility of releasing Rashid under strict conditions and listed the matter for further hearing on November 3.
Court Suggests Delhi-Only Condition
During the hearing, the court acknowledged Rashid’s influence, particularly after his election as a Member of Parliament.
The bench asked the NIA to consider whether the perceived risk associated with his physical presence in Kashmir could be addressed by imposing a condition requiring him to remain in Delhi if granted bail.
The court specifically sought the agency’s response on whether Rashid could be released subject to stringent restrictions, including remaining within the national capital.
Nearly Seven Years in Custody
The High Court also noted that Rashid has spent almost seven years in custody and that the case involves approximately 240 witnesses.
Given the large number of witnesses, the court observed that the trial could take considerable time to conclude.
Rashid is seeking regular bail in the case registered under provisions of the Unlawful Activities (Prevention) Act (UAPA).
NIA Opposes Bail
The NIA opposed the bail plea, arguing that sufficient material exists on record to establish a prima facie case against Rashid.
The agency’s counsel submitted that the allegations against the MP are serious and alleged that he was involved in anti-national activities, including allegedly funding stone-pelters after receiving money from Pakistan.
The NIA also alleged that Rashid had engaged in hate speech.
These are allegations in the ongoing case and will be subject to judicial determination.
Rashid Arrested in 2019
Rashid has been lodged in Tihar Jail since 2019, following his arrest by the NIA in connection with the 2017 terror-funding case.
He was subsequently named in an NIA chargesheet filed in October 2019.
In March 2022, a special NIA court framed charges against Rashid and other accused under provisions including Section 120B (criminal conspiracy), Section 121 (waging war against the Government) and Section 124A (sedition) of the Indian Penal Code, along with relevant provisions of the UAPA.
Earlier Interim Bail
Rashid was previously granted interim bail to attend ceremonies related to the demise of his father.
The latest proceedings, however, concern his plea for regular bail while the broader terror-funding trial continues.
What the Court’s Move Means
The High Court has not granted bail at this stage. Instead, it has asked the NIA to consider whether strict safeguards — potentially including a requirement that Rashid remain in Delhi — could address the agency’s concerns.
The NIA’s response is expected to be considered when the matter comes up again on November 3, 2026.
